OLG Stuttgart, Urteil vom 04.11.2021, 2 U 49\/21 \u2013 Unzul\u00e4ssige gesundheitsbezogene Angaben zur Verringerung von Hautfalten.<\/strong><\/p>\n

Aussagen \u00fcber die Verringerung von Hautfalten in der Werbung f\u00fcr ein Lebensmittel sind als spezifische gesundheitsbezogene Angaben i.S.v. Art. 10 der VO (EG) Nr. 1924\/2006 des Europ\u00e4ischen Parlaments und des Rates (sog. Health-Claims-Verordnung) einzuordnen, wenn der optische Effekt einer Steigerung k\u00f6rperlicher Funktionen beschrieben wird. Die Einordnung h\u00e4ngt von den Umst\u00e4nden der Werbung ab, insbesondere davon, ob die Angabe in einem gesundheitsbezogenen Kontext verwendet wird. Es reicht aus, dass sie bei einem Durchschnittsverbraucher einen entsprechenden Eindruck hervorrufen kann.<\/i><\/p>\n

Geworben wurde mit: \u201eWirkt von innen heraus. Der Collagen Youth Drink mit 2500 mg Kollagen und weiteren hocheffizienten Wirkstoffen verbessert das Erscheinungsbild der Haut durch [\u2026] weniger Falten.\u201c, \u201eReduziert Falten\u201c und \u201eINNERBEAUTY wirkt gegen Hautalterung\u201c.<\/p>\n

Bei diesen Angaben handelt es sich um spezifische, gesundheitsbezogene Angabe ohne Listenzulassung.<\/p>\n
