{"id":1659,"date":"2024-11-15T09:39:02","date_gmt":"2024-11-15T08:39:02","guid":{"rendered":"https:\/\/www.lawpoint.at\/?p=1659"},"modified":"2025-01-17T09:40:12","modified_gmt":"2025-01-17T08:40:12","slug":"haendedesinfektionsmittel-hautfreundlich-nicht-erlaubt","status":"publish","type":"post","link":"https:\/\/www.lawpoint.at\/en\/haendedesinfektionsmittel-hautfreundlich-nicht-erlaubt\/","title":{"rendered":"H\u00e4ndedesinfektionsmittel \u2013 \u201ehautfreundlich\u201c nicht erlaubt"},"content":{"rendered":"<div class=\"content_row row vc_row wpb_row  default-style fullwidth\">\n\t\n\t<div class=\"content_row_wrapper  default\">\n\t<div class=\"vc_col-sm-12 wpb_column vc_column_container rt-column-container\">\n\t<div class=\"vc_column-inner rt-column-inner\">\n\t\t<div class=\"wpb_wrapper rt-wrapper\">\n\t\t\t\n\t<div class=\"wpb_text_column wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><strong>dBGH, Urteil vom 10.10.2024, <a href=\"https:\/\/juris.bundesgerichtshof.de\/cgi-bin\/rechtsprechung\/document.py?Gericht=bgh&amp;Art=en&amp;nr=139281&amp;pos=0&amp;anz=1\">I ZR 108\/22<\/a>, <\/strong>Aus den Entscheidungsgr\u00fcnden:<\/p>\n<p><em>Der Begriff \u201e\u00e4hnliche Hinweise&#8220; im Sinne des Art. 72 Abs. 3 Satz 2 der Verordnung VO (EU) Nr. 528\/2012 umfasst jeden Hinweis in der Werbung f\u00fcr Biozidprodukte, der &#8211; wie die in dieser Bestimmung genannten Angaben &#8211; diese Produkte in einer Art und Weise dar-stellt, die hinsichtlich der Risiken dieser Produkte f\u00fcr die Gesundheit von Mensch oder Tier oder f\u00fcr die Umwelt oder ihrer Wirksamkeit irref\u00fchrend ist, indem er diese Risiken verharmlost oder sogar negiert, ohne jedoch zwingend allgemeinen Charakter zu haben (An-schluss an EuGH, Urteil vom 20. Juni 2024 &#8211; C-296\/ 23, GRUR 2024, 1226 [juris Rn. 48] &#8211; dm-Drogerie Markt).<\/em><\/p>\n<p><em>Den in Art. 72 Abs. 3 Satz 2 Biozid-VO genannten Angaben einschlie\u00dflich der \u201e\u00e4hnlichen Hinweise&#8220; liegt eine abstrakte Irref\u00fchrungsgefahr zugrunde, die das Verbot entsprechender Werbeaussagen rechtfertigt. Auf eine konkrete Irref\u00fchrung im Einzelfall kommt es nicht an.<\/em><\/p>\n<p><em>Die Bezeichnung eines Biozidprodukts als \u201eHautfreundlich&#8220; stellt eine Angabe dar, die als \u201e\u00e4hnlicher Hinweis&#8220; unter das Verbot des Art. 72 Abs. 3 Satz 2 der Verordnung VO (EU) Nr. 528\/2012 f\u00e4llt.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>Ein Wettbewerbsverein klagte ein Unternehmen, welches ein Desinfektionsmittel unter anderem mit \u201ehautfreundlich \u2013 bio \u2013 ohne Alkohol\u201c bewarb.<\/p>\n<p>Nach Artikel 72 Abs 3 Satz 2 Biozid-Verordnung darf die Werbung f\u00fcr ein Biozid-Produkt auf keinen Fall die Angaben \u201eBiozid-Produkt mit niedrigem Risikopotenzial\u201c \u201eungiftig\u201c, \u201eunsch\u00e4dlich, \u201enat\u00fcrlich\u201c, \u201eumweltfreundlich\u201c, \u201etierfreundlich\u201c oder \u00e4hnliche Hinweise enthalten. Der BGH f\u00fchrte dazu aus, dass hautfreundlich als \u00e4hnlicher Hinweis im Sinne dieses Verbotes anzusehen ist.
