Art.\u00a07 Abs.\u00a03 LMIV dar. Nach Art.\u00a07 Abs.\u00a03 LMIV ist es verboten, einem Lebensmittel Eigenschaften der Vorbeugung, Behandlung oder Heilung einer menschlichen Krankheit zuzuschreiben oder den Eindruck dieser Eigenschaft entstehen zu lassen. Lebensmittel im Sinne der Verordnung sind alle Stoffe oder Erzeugnisse, die dazu bestimmt sind oder von denen nach vern\u00fcnftigem Ermessen erwartet werden kann, dass sie in verarbeitetem, teilweise verarbeitetem oder unverarbeitetem Zustand von Menschen aufgenommen werden, Art.\u00a02 Abs.\u00a01a) LMIV, Art.\u00a02 Abs.\u00a01 Lebensmittel-Basis-VO (VO (EG) 178\/2002). Die streitgegenst\u00e4ndlichen Mineralstofftabletten fallen hierunter. Als Krankheit im Sinne von Art.\u00a07 Abs.\u00a03 LMIV sind u.a. auch die mit \u00fcberm\u00e4\u00dfigem Alkoholgenuss verbundenen Symptome (\u201eAlkoholkater\u201c) einzustufen. Mit einer weiten Auslegung des Verordnungsbegriffs soll der Gefahr begegnet werden, dass Lebensmittel als Arzneimittelersatz angesehen und ohne zureichende Aufkl\u00e4rung zur Selbstbehandlung eingesetzt werden. Aussagen und Angaben, wonach ein Lebensmittel geeignet ist, diesen Symptomen vorzubeugen oder diese zu lindern, sind daher unzul\u00e4ssig.<\/em><\/p>\n<p>Die Entscheidung erging in Form eines Vers\u00e4umnisurteiles, das beklagte Unternehmen hatte also gegen die wettbewerbsrechtliche Klage eines Klagsvereines nichts unternommen. Die Klage betraf \u201eDextro-Energy\u201c Mineralstofftabletten mit der Angabe \u201eAnit-Kater\u201c, welche unter anderem Elektrolyte enthielten. Die Entscheidung bezog sich auf das Verbot der LMIV, einem Lebensmittel Eigenschaften der Vorbeugung, Behandlung oder Heilung einer menschlichen Krankheit zuzuschreiben oder den Eindruck dieser Eigenschaften entstehen zu lassen. Alkohol-Kater wurde also als Krankheit eingestuft.
