Mit 01.01.2025 ist die Neufassung des \u00a7 2h AVRAG in Kraft getreten, der die zentrale Rechtsgrundlage f\u00fcr Telearbeit darstellt.<\/p>\n

\u201eHome Office\u201c wird durch \u201eTelearbeit\u201c ersetzt. Dar\u00fcber hinaus wird der Begriff \u201eTelearbeit\u201c erstmals umfassend definiert und auf die Arbeit au\u00dferhalb der Wohnung ausgedehnt. Dies umfasst nicht nur T\u00e4tigkeiten, die in der eigenen Wohnung oder im Wohnhaus der Arbeitnehmer\/-innen stattfinden, sondern auch solche an anderen selbstgew\u00e4hlten Orten wie Coworking-Spaces oder Internet-Caf\u00e9s. Entscheidend ist, dass die Arbeit regelm\u00e4\u00dfig und in grobem Zusammenhang mit der Nutzung von Informations- und Kommunikationstechnologien verbunden ist.<\/p>\n

Wie bisher setzt Telearbeit eine schriftliche Vereinbarung zwischen Arbeitnehmer\/-in und Arbeitgeber\/-in voraus. Ein zentrales Prinzip bleibt somit die Einvernehmlichkeit: Weder k\u00f6nnen Arbeitgeber\/-innen Telearbeit einseitig anordnen, noch haben Arbeitnehmer\/-innen einen Rechtsanspruch darauf.<\/p>\n

Eine weitere wichtige Neuerung betrifft den Unfallversicherungsschutz. Je nach Ort der Telearbeit wird zwischen Telearbeit im engeren Sinne und Telearbeit im weiteren Sinne unterschieden, woraus sich Unterschiede beim unfallversicherungsrechtlichen \u201eWegeschutz\u201c ergeben.<\/p>\n

Neben den arbeitsrechtlichen Aspekten wurde auch die Regelung zum Telearbeitspauschale angepasst. Dieses betr\u00e4gt weiterhin bis zu drei Euro pro ausschlie\u00dflichem Telearbeitstag und ist f\u00fcr maximal 100 Tage im Kalenderjahr steuerfrei. Neu ist, dass die berufliche T\u00e4tigkeit nicht mehr ausschlie\u00dflich in der Wohnung ausge\u00fcbt werden muss, um das Pauschale zu beanspruchen. Auch andere \u00d6rtlichkeiten, die nicht zum Unternehmen geh\u00f6ren, sind nun zul\u00e4ssig. Wichtig bleibt, dass die Telearbeitstage sowie das gew\u00e4hrte Pauschale im Lohnkonto erfasst und auf dem Lohnzettel ausgewiesen werden m\u00fcssen. Betr\u00e4ge, die den H\u00f6chstbetrag von 300 Euro \u00fcbersteigen, gelten wie bisher als steuerpflichtiger Arbeitslohn und werden im Rahmen der Veranlagung nachversteuert.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n\n\t\t<\/div>\n\t<\/div>\n\t<\/div>\n\n<\/div>\n<\/div>\n\n
